General Provisions:

NAVRCHOLU.cz system for monitoring and analyzing traffic on Internet pages ("System") is run by Internet Info, s.r.o. ("Operator"). Participation in the System is voluntary; by registering in the System, the maintainer of the WWW pages ("User") agrees to be bound by all the terms and conditions stated here.

Conditions for Participating in the System:

1. The basic unit of the System is a website ("Site"), i.e. a group of WWW pages forming a single logical unit and located at a single Internet address (second or third level domain, or a stand-alone directory).
2. The User places the HTML code that was generated by the System upon registration into the pages of his/her Site. It is not possible to monitor traffic without placing the code into the pages. It is recommended to place the code into every page of the monitored Site. Only pages which contain the code are monitored. Pages without the monitoring code are ignored by the System and their traffic is not monitored or counted.
3. Every Site has a unique code, determined by its identification number ("ID")
4. If the same content is published at more locations, i.e. it is mirrored, it is allowed to use one ID for all mirrors.
5. It is prohibited to place more than one monitoring code of the System into a single page (regardless of whether with the same ID or with different ID's). One Site is only allowed to use a single ID.
6. It is prohibited to place the code into other pages than those for which it is intended (this also applies to the frame and iframe technologies). It is also impermissible to automatically open new browser windows that contain the monitoring code of the System and artificially increase the traffic of other pages in this way. It is also prohibited to place the code into pages that are refreshed automatically without any user intervention.
7. It is prohibited to modify the monitoring code to the effect that the traffic is illicitly increased. Modifications needed to integrate the monitoring code for example with dynamically generated pages are allowed, but in that case the Operator does not guarantee correct operation of the code.
8. A Site will not be registered if
   1. it is not operational at the time of the registration, it also means the Site must be accessible without a password and it must not be under construction.
   2. its content violates the law of the Czech Republic
   3. it could harm the reputation of the Operator
   4. it provides erotic content and is run outside the .CZ top-level domain
   5. it works as a dealer Site offering products and services without proper information about the seller and also similar Sites that transfer users to Sites that are already registered in the System or Sites that have been removed due to breaking the Terms of Use.
9. The participation in the Monitoring is free of charge only for Sites with a monthly traffic up to 500,000 page impressions. Other Sites may use one of the paid plans.
10. If there is not at least one page impression within 60 days, it will be cancelled. This clause does not apply to Sites that are using the Profi or Platinum plans.
11. The User shall inform the Operator of any major change to the content or subject of the Site to ensure that the Site is moved to the correct section by topic.
12. When registering a Site, the User shall give correct information about the Site.
13. The User shall inform the Operator of any facts that could have an impact on the operation of the service or on the accuracy of the results.
14. The Operator has the right to send electronic mail to the User with information related to the System or to other activities of the Operator, including respective offers of paid services, information about discounts and so on. The User expressly agrees that this electronic mail, which is a prerequisite for participating in the System, may be sent to him/her.

Rights and Responsibilities

1. The Operator shall not be liable for any damages arising out of the fact that the System is not operating because of computer system breakdown, failures of the Internet provider (ISP), or in case of defenses that justify the act.
2. The Operator reserves the right to bring the System down for technical reasons to do maintenance, which may cause that the monitoring part or the statistics at NAVRCHOLU.cz are temporarily out of service. In case the total down time exceeds 48 hours within one month, the User has the right to get a discount, which is proportional to the price of the down time above 48 hours.
3. The Operator reserves the right to hide some types of Sites or any individual Site from the publicly available traffic lists of the System or from any individual list.
4. The User is obliged to keep the login name and password to the System in such a way that it cannot be abused. Should the password be disclosed to third parties or should non-authorized extensions created by the User be placed in the interface to the system, the Operator shall not be liable for any data abuse.
5. Participation in the System is voluntary and the User has the right to immediately terminate the services at any moment.
6. If the termination is due to repeated serious violation of these rules by the Operator, and the User made a previous written notice and provided adequate time for remedy, the User of the Profi or Platinum plan has the right to receive a refund of the cost that is proportional to the remaining time of the prepaid services.
7. If these rules are violated by the User, the Operator has the right to inflict some form of punishment on the User, e.g. a reprimand or a public admonition of the User's improper action.
8. If these rules are seriously violated by the User or if the Site does not meet one of the conditions for participating in the System, the Operator may completely remove the User or Site from the System. First, the Operator shall give the User a warning that he/she is violating the rules or conditions for participating; this warning shall be sent via email to the address specified in the System. The User may express his/her opinion within five workdays. The Operator may hide the Site from other Users during this period, which does not affect the monitoring or the accessibility of the statistics in the private section of the User. If the User does not send his/her opinion to the matter in the above-mentioned period and does not adjust the situation so that it no longer violates these rules, the Operator may remove him/her from the System. In that case he/she does not have the right to receive a refund of the cost of the remaining time of the prepaid services.
9. The Operator may decide to terminate the System or to terminate the monitoring of an individual Site. In this case, the Operator shall give the User a warning at least 14 days before the moment when the services are terminated. If the Site of the User uses the paid Profi or Platinum plan, he/she has the right to receive a refund of the cost that is proportional to the remaining time of the prepaid services.
10. The Operator may unilaterally change these rules. Users shall be informed of any change to the rules at least 14 days before the change becomes effective, either by an email sent to the contact address specified in the System, or by a note published at the NAVRCHOLU.cz site.
11. The relationships between the Operator and the User arising out of these rules are subject to the Czech Business Code (Act No. 513/1991 with later amendments).

Protection of Personal Data of Visitors to Servers Using the Services of the NAVRCHOLU.cz system

The NAVRCHOLU.cz system does not gather any personal data which could identify a specific person, except in cases where the person himself/herself voluntarily provides such data to NAVRCHOLU.cz. NAVRCHOLU.cz gathers only technical data about the visits to WWW pages and uses only openly available information sources, revealed by every WWW browser in a request made to a server. This statistical data cannot be linked to any personal data of the visitors of the pages.

Protection of Data about Servers Using NAVRCHOLU.cz Services

The Operator guarantees that acquired statistical data about specific servers are not sold or otherwise made accessible to third parties. An exception to this is data which the User (operator of the Site) makes freely accessible to the visitors of NAVRCHOLU.cz.

The Operator reserves the right to provide the data acquired by running the service to third parties as a package with aggregated data and no possibility of using such package to get any information about specific servers and persons.
